Protection of children right: Proceeding
The petition can be filed by a child personally, by his/her parent or guardian, or any other person acting in the child’s name; also, by an organ or organization that shall acquire any information that a certain right of the child has been violated. The Head of the Department charged with the protection of children’s rights starts the procedure for the protection of the rights of a certain child at her own initiative as well if she comes by such information from mass media or by any other means; of course, only in cases of proven violations of children’s constitutional and legal rights by the organs and organisations before which the Ombudsman handles with authority.
The Ombudsman is authorised to protect the rights of citizens as individuals, therein also encompassing the rights of children guaranteed by international acts ratified in compliance with the Constitution and that represent a part of our legal system.
The special rights of children for which the Ombudsman can secure protection are the rights set forth by virtue of several laws in the Republic of Macedonia from various fields when these rights are realised and exercised through the organs of the state administration or other organs and organisations with public authorities with the competence to make decisions pertaining to certain rights of children.
