COLLECTIVE TURNING OFF OF THE POWER IS ILLEGAL MEASURE
Regarding information published in the media that because decreased payment of electricity bills the EVN – ESM in some settlements turns off electricity collectively with aim to force irregular payers to pay their bills without taking care that turns off of the power households which has paid electricity bills the Ombudsman points on following:
By collective turning off of the power EVN – ESM acts in a contrary of the relevant laws and puts in a position of common debtors all inhabitants groundlessly regardless that some consumers are paying electricity bills continuously and timely. This arises from the undoubted fact that every bill has recorded every user separately which means that bills refers on the relevant user separately and it can’t refer to the other users.
The Ombudsman think that the EVN – ESM should ask for payment of submitted bills but it should be done only on way in accordance with laws and positive regulations such are the Law on Energetic, the Conditions for Electricity Supply and the Law on Obligate Relations.
According to this the Ombudsman recommends EVN – ESM to stop immediately with illegal measure of collective turning off of the power and to plug on all users who are paying bills regularly.
